(1) The State Peace and Development Council The Law Amending the Union of Myanmar University Education Law, 1973

(The State Peace and Development Council Law No 4/98)

The 13th Waning Day of Tabaung 1359 ME

(25th March, 1998)

The State Peace and Development Council hereby enacts the following Law:

1. This Law shall be called the Law Amending the Union of Myanmar University Education Law, 1973.

2. In sub-section (b) of section 2, section 3, section S and clause (2) and clause (9) of sub-section © of section 8 of the Union of Myanmar University Education Law, 1973, before the expression "College" the expression "Degree College" shall be inserted.

3. Sub-sections (a) and (b) of section 8 of the Union of Myanmar University Education Law, 1973 shall be substituted as follows:-

"8. (a) The Government shall form the Universities Central Council comprising the following persons, in order to lay down policy, to give guidance and to supervise in respect of university education:

(1) Minister, Ministry of Education Chairman

(2) Ministers of relevant Ministries administering the University, Degree College, College and Institute Member

(3) Persons assigned duty by the Government Member

(4) Heads of Departments and Organizations under the Ministry of Education Member

(5) Rectors Member

(6) Principals of Degree Colleges and Institutes Member

(7) Deputy Minister, Ministry of Education Secretary

(b) In forming the Universities Central Council, the Government may, if necessary, determine the Vice-Chairman and the Joint Secretary from among the members of the Universities Central Council."

4. Sub-sections (a) and (b) of section 9 of the Union of Myanmar University Education Law, 1973 shall be substituted as follows:

"9.(a) The Government shall form the Council of University Academic Bodies in order to supervise all matters relating to standard of university education, syllabus, examination and education.

(b) The Council of University Academic Bodies shall comprise the following persons:

(1) Minister, Ministry of Education (Chairman)

(2) Deputy Minister, Ministry of Education (Vice Chairman)

(3)Deputy Ministers of relevant Ministries administering the University, Degree College, College and Institute (member)

(4)Persons assigned duty by the Government (Member)

(5)Heads of Departments and Organizations under the relevant Ministry administering the University, Degree College, College and Institute (Member)

(6)Heads of Departments and Organizations under the Ministry of Education (Member)

(7) Rectors Chairman Vice-Chairman (Member)

(8)Principals of Degree Colleges and Institutes (Member)

(9)Director General, Higher Education Department Secretary (Lower Myanmar) (Secretary)

(10)Director General, Higher Education Department Joint Secretary" (Upper Myanmar)

5. Clause (7) of sub-section © of section 9 of the Union of Myanmar University Education Law, 1973 shall be substituted as follows:

"(7) to implement, after scrutinizing the university education development measures submitted by the respective University Academic Bodies."

6. The expression "University or College and Institute" contained in section 10 of the Union of Myanmar University Education Law, 1973 shall be substituted by the expression"University, Degree College, College and Institute."

7. Section 11 of the Union of Myanmar University Education Law, 1973 shall be substituted as follows:

"11.(a) The Ministry of Education shall, to enable systematic administration of the universities under it form the Higher Education Department (Lower Myanmar) and the Higher Education Department (Upper Myanmar).

(b) The other Ministry which administers the university or universities shall, to enable systematic administration of the university or universities under it determine and assign duty to any department as may be necessary."

8. In section 12 of the Union of Myanmar University Education Law, 1973:

(a) the expression "Ministry of Education or" contained in clause (3) of subsection (b) shall be deleted;

(b) clause (7) of sub-section (b) shall be substituted as follows:

"(7) Head of Department ... Secretary (Administration/Finance) or Registrar or Assistant Registrar'';

© sub-section (f) shall be substituted as follows:

"(f) The relevant Ministry administering the Degree College, College and Institute shall form the Management Bodies of Degree College, College and Institute and determine the duties and functions thereof."

9. Section 15 of the Union of Myanmar University Education Law, 1973 shall be substituted as follows:

15. To carry out the provisions contained in this Law:

(a) the relevant Ministry administering the University, Degree College, College and Institute may, with the approval of the Government, issue rules and procedures;

(b) the relevant Ministry administering the University, Degree College, College and Institute or the Department under such Ministry may issue such orders and directives as may be necessary."

(2) Premier Goh Chok Tong addresses Myanmar-Singapore economic talks

YANGON, 25 Mar - Visiting Prime. Minister of the Republic of Singapore Mr Goh Chok Tong attended the Myanmar-Singapore economic talks at the Sedona Hotel on Kaba Aye Pagoda Road at 9 am today.

Also present at the discussions were Minister for National Planning and Economic Development U Soe Tha, Minister for Commerce Maj-Gen Kyaw Than, Minister at the Office of the Chairman of the State Peace and Development Council Brig-Gen Abel, Minister at the Office of the State Peace and Development Council Secretary of Myanmar Investment Commission Brig-Gen Maung Maung, Minister for Finance and Revenue U Khin Maung Thein, Minister for Foreign Affairs U Ohn Gyaw, Minister for Hotels and Tourism Maj-Gen Saw Lwin, Deputy Minister for NPED Brig-Gen Zaw Tun, Deputy Minister for Construction Brig-Gen Thura Aye Myint, heads of departments of economic organizations, Minister of Foreign Affairs of Singapore Professor S Jayakumar and other high-ranking officers, Ambassador of Singapore to Myanmar Brig-Gen Patrick Choy Choong Tow, businessmen of Singapore accompanying the Premier and Singaporean entrepreneurs in Myanmar.

Minister at the Office of the Chairman of the State Peace and Development Council Brig-Gen Abel clarified current economic developments in Myanmar.

Next, leader of Singaporean entrepreneurs Chairman of NTUC Fairprice Cooperatives Mr Chandra Das spoke at the discussions.

Visiting Prime Minister Mr Goh Chok Tong then explained bilateral cooperation in promoting trade between Myanmar and Singapore.

The ministers concerned then replied to queries on economic matters asked by Singaporean entrepreneurs. The discussions ended at 10.20 am.

(3) No 4 Wharf of Myanmar Integrated Port Ltd of Singapore opens at Thilawa Port

YANGON, 25 Mar - No 4 Wharf of Myanmar Integrated Port Ltd of Singapore was opened at Thilawa Port in Kyauktan Township, Yangon South District, today, attended by Secretary-1 of the State Peace and Development Council Lt-Gen Khin Nyunt.

Minister for Transport Lt-Gen Tin Ngwe said soft opening of the wharf with a frontage length of 198 metres and two 108-metre bridges was held in January 1998.

The wharf, located at No 4 Plot of Thilawa Port, was built by the Singaporean company under BOT system in accord with an agreement reached between Myanma Port Authority and the company on 10 July 1996, he said.

The first phase of Thilawa Port Development Project includes 17 land plots each with a 200-metre frontage and 750-metre inland width.

Of the 17 plots, ten are being developed by foreign investors beginning June 1995, he said.

In addition to freight handling work, the wharf will be engaged in production and conveying of edible oil, he stated, adding its production work includes manufacturing edible oil containers (drums), crushing edible oil seeds, edible oil purification, drum filling operation and feedstuff production.

Thilawa Port Development Project was laid down by Special Projects Implementation Committee Meeting 2/94 on 1 June 1994, he said.

Director Mr Chong Choon Nean of the company also spoke.

CEO of Transpace Capital Pte Ltd of Singapore Dr Christopher Leong presented a souvenir to the Secretary-1.

Lt-Gen Khin Nyunt unveiled the plaque.

Minister Lt-Gen Tin Ngwe and Managing Director Mr Soon Kim Ing of MIRL formally opened the wharf.

Hailing the 53rd Anniversary Armed Forces Day, Mr Soon presented K 10 million for Tatmadaw health care projects and another K 10 million for health development programmes of Ministry of Health.

Lt-Gen Khin Nyunt accepted the cash.

The Secretary-1 and party observed filling of drums with edible oil from storage tank and making of drums.

(4) Deputy Prime Minister receives Australian businessmen

YANGON, 25 Mar - Deputy Prime Minister Lt-Gen Tin Tun received President Mr Steve Scudamorg of PKMG Chartered Accountants and Director-General (Technical) Mr Geoff Davis of Golden Valley Mining NL Co Ltd of Australia at his office at 5 pm today.

(5) MIC Chairman receives President of Premier Petroleum Myanmar

YANGON, 25 Mar - Chairman of Myanmar Investment Commission Deputy Prime Minister Vice-Admiral Maung Maung Khin received President Mr Ronald L Morris and party of Premier Petroleum Myanmar Ltd at his office at 4 pm today.

Present also were Minister at the Office of the State Peace and Development Council Secretary of Myanmar Investment Commission Brig-Gen Maung Maung, Deputy Minister for Energy U Tin Tun and officials.

(6) More go shopping at Special Market Festival

YANGON, 25 Mar - The Special Market Festival hailing the 53rd Anniversary Armed Forces Day continued for the tenth day today in the GEC Hall on the second floor of the Nyaungbinlay Plaza here from 9 am to 6 pm. A greater number of visitors went shopping there today.

The products on sale included enamel wares, garments, personal goods, cosmetics, electrical appliances, toys and others.

The festival will be held up to 31 March. Maha Thingyan Special Market Festival will commence on 1 April till 10 April in the same hall. Interested persons may dial 210793 and 210794 to contact the GEC Hall.

(7) Ministers visit Yenangyoung Industrial Zone

YANGON, 25 Mar - Minister for Electric Power Maj-Gen Tin Htut, accompanied by officials of Myanma Electric Power Enterprise, visited the Taungdwingyi Power Sub-station in Magway Division on 22 March evening. He met the District and Township Peace and Development Council Chairmen and members, Magway Division and Township Electrical Engineers, the manager of the Power Sub-station and staff and discussed power supply, improvements to be made, collection of arrears and future tasks.

On 23 March morning, Minister Maj-Gen Tin Htut together with Minister for Industry-2 Maj-Gen Hla Myint Swe proceeded to the Yenangyoung Industrial Zone in Magway Division. They later visited Yenanmyay Machinery Workshop and the workshop of Naungyo Motor-car and Machinery Repair Cooperative Society in Yenangyoung and viewed production of machinery and equipment.

In the evening, the Minister for Electric Power visited Mann LPG Plant, Mann Oil-field and Mann Natural Gas-Powered Power Station. He inspected functions of the plants and power supply and fulfilled the requirements.

He met the staff of Mann Power Station yesterday and called on them to work hard, abide by the rules, minimize power losses and take care of staff welfare.

The inspection tour also took him to the Township Electrical Engineer's officers in Okkan and Taikkyi.

(8) Computer exhibition and talks to mark ICST founding anniversary

YANGON, 25 Mar - Computer exhibition and talks to mark the tenth founding anniversary of the Institute of Computer Science and Technology will be held at the Yangon University Diamond Jubilee Hall on Pyay Road from 28 to 30 March.

The exhibition will also display hardwares and softwares of ICST graduates in addition to facts about the institute.

Similarly, 25 domestic computer companies will open 50 booths.

Computer experts of the institute and those of the computer centres will lecture computer technology from 11 am to 1 pm daily.

Admission is free and visitors can take part in computer quiz and win lucky draws which include computers and computer parts.

(9) GSMED, Palmer Resources Ltd sign agreement on mineral exploration and feasibility study in Kyaikhto Township

YANGON, 25 Mar - The Geological Survey and Mineral Exploration Department of the Ministry of Mines and Palmer Resources Ltd of Canada today signed an agreement for mineral exploration and feasibility study in Meyongyi and Meyongale area, Kyaikhto Township, Mon State.

The agreement signing ceremony held at the ministry this morning was attended by Minister at the Office of the Chairman of the State Peace and Development Council Brig-Gen Maung Maung, Minister for Mines Brig-Gen Ohn Myint and Deputy Minister U Myint Thein, heads of departments concerned, Director of Palmer Resources Ltd Mr David L Seymour and guests.

Speaking on the occasion, Minister Brig-Gen Ohn Myint said Myanmar is now practicing market-oriented economic system and inviting foreign investors for economic and technical development in mining sector.

The contract will contribute toward development of the country's mining sector, he said.

He expressed his appreciation of mining projects of the company in Indonesia, the Philippines and Vietnam and said the Block 13 in the area have good geological prospects in gold mining, adding the locals are exploring gold in that area.

The minister also expressed his belief that ensure mutual benefit that Palmer Resources will find mineral deposits which will.

He called for considering environmental pollution which may be caused by mineral exploration and production.

Mining companies should consider making arrangements for environmental conservation plans which will prevent socio-economic problems and pollution, he said, adding the arrangements will prove that mineral exploration and production is not something as seen by others, he said.

Afterwards, Deputy Director-General of GSMED U Danny Sein and Mr Seymour spoke.

Minister Brig-Gen Maung Maung gave the permit for investment to Mr Seymour and Minister Brig-Gen Ohn Myint the permit for mineral exploration and feasibility study.
